1) Mediation is win-win. Unlike the court system, it’s not adversarial, so you can both emerge as winners from the process.
2) You own the solution, so are both more likely to stick to the agreement made. Because you have worked together to develop an understanding and agreement, supported by trained mediators, you own that agreement, and you have much more interest in maintaining it.
3) Mediation is usually much cheaper than going to court. For example, Surrey Mediation Service offers fixed price mediation packages for developing separation agreements, resolving workplace disputes and in other areas. The costs of mediation are usually shared, and it generally works out much cheaper.
