Mediation can help you reach an agreement much more quickly and cheaply than litigation. What’s more, because it’s non-confrontational, you can hammer out a win-win agreement, instead of the win-lose that tends to emerge from court proceedings. And in family situations, win-win is much better for everyone, not least because it tends to be less damaging to relationships.
Mediation costs from £120 per hour, which is usually shared between the two parties. Generally a trained family mediator will meet each of you separately at first, and then plan a joint mediated session in which you discuss the issues that you have raised, and try to reach agreement on them. Unlike the courts, where a decision is imposed on you by the court, you make your own agreement, which can be made legally binding. You don’t need legal representation, although legal advice can sometimes be helpful.
